Following his death from lung cancer last week, it has been suggested that the cause of Malcolm McLaren’s illness was his contact with asbestos whilst working in the shop he shared with Vivienne Westwood in the 70s.

McLaren was known by many for setting up his ‘SEX’ clothing shop in 1974 with the grand dame of British punk dressing, Vivienne Westwood, where they pushed the boundaries of fashion and supplied the outrageous clothing that dressed an anarchic generation.

But McLaren’s partner Young Kim has suggested that his beloved shop may have been the reason behind his cancer, and in turn his death, after he was exposed to asbestos there for prolonged periods of time, following some DIY renovations.

He decided he wanted the roof to look as though a bomb had hit it and so ripped through some of the ceiling to give this effect. In doing so the asbestos which had previously been unseen became damaged and exposed, which is when it can cause illness. In subsequent years McLaren spent much of his time in the shop, which of course meant he was exposed to asbestos.

Lung Cancer is a common type of cancer linked to those who have been exposed to asbestos over a period of time. It makes breathing difficult as it develops in the tissue around the lungs and so decreased breathing capacity.

McLaren became concerned in his later life that he had developed cancer, and shared his worries with his doctor. Spots were found on his lungs, but the doctor assured McLaren they were benign and it was only in 2009 that he was actually diagnosed with lung cancer. It is unclear whether an earlier diagnosis would have saved his life, but that is certainly what those close to him suspect.

For now McLaren’s friends and family are contemplating life without the pragmatic man, but reports suggest his partner Young Kim is likely to make a complaint about the doctor involved.

Why Texas Has Many Reported Cases Of Mesothelioma Injury Claims

What does the great state of Texas have in common with mesothelioma injury cases? We are going to find out.

Mesothelioma, some lung cancers and asbestosis are being directly linked to exposure to asbestos. This potentially dangerous material was very popular and was therefore massively used in the building industry. Well, up until a certain point and before the good reputation fell apart practically within a matter of months.

Asbestos was known for being very resistant to heat and fire. That’s why it was used a lot in areas that carried a higher risk of developing fires. But there is also another side to the story. As mentioned, a few decades later it was proven that asbestos was the cause of more and more people getting diagnosed with asbestosis and mesothelioma.

And Texas all of a sudden was listed among the top ten states of reported mesothelioma incident rates. It was number five right after California, New York, Florida and Pennsylvania.

One may ask now, if there could be an underlying reason for the fact that Texas is so high up on this list. A rather obvious one is the fact that this state is known for having a huge petroleum industry and a lot of ship building facilities. Both use asbestos a lot. And after all, there are also many regular homes that were never updated and therefore may still contain risky quantities of the material.

As we all know, asbestos was very popular and therefore widely used up until the 80s. Since it could be produced easily and inexpensively, some companies in the building supply industry started to focus only on manufacturing asbestos based products.

If you come across a house that was built prior to 1975, it might still have asbestos siding and asbestos roofing on it. Interestingly, there seems to be a geographic pattern that indicate hotspots within the state of Texas: Galveston, Jefferson, Harris, Bexar, Tarrant and Dallas county clearly stand out as reporting the highest number of new mesothelioma injury diagnoses.

If there’s an accident or an injury, there is a lawyer, right? Personal injury lawyers had all of a sudden a new business niche to expand into. Mesothelioma class action lawsuits caught the public’s eye, because of the big time money that was involved in those cases.

The whole area of mesothelioma and lawsuits grew into a large and lucrative business enterprise for personal injury attorneys. Mesothelioma compensation claims don’t necessarily need to go through a jurisdictional procedure. The compensation settlement money comes from previously installed trust funds, generated by corporations in the asbestos industry.

Benefits Of Getting Mesothelioma Compensation

Mesothelioma compensation is such a kind of compensation where the opposition pays a huge amount to the victim who gets this disease. Mesothelioma is very dangerous where the victim gets less than 24 hours to live. This disease is so dangerous that no compensation can compensate its pain.

This is a fatal type of cancer which directly affects the mesothelial cells and suddenly the function of these cells get disturbed. They start reacting in a very abnormal way and even start dividing themselves. Mostly the laborers, who day to day work in a factory and face the asbestos exposure, get affected by this disease.

So in case somebody whom you know has this deadly disease, then you must get their family members to sue the factory owners. This is because of over use of asbestos only the laborers get affected by this deadly disease. So if your doctor confirms you that your loved one is affected by this disease, you must consult a lawyer for the compensation.

Mesothelioma compensation can actually get you a very large amount, if you get a good lawyer for yourself who will fight for the victim. You must choose the best lawyer who will help you to fight for the justice.

One thing you must remember while you choose a lawyer is to never go for an inexperienced lawyer. He or she won’t be able to teach you the tricks and turns of the case which an experienced lawyer can teach you. The experienced lawyer can understand all the loop holes of the case.

Even these lawyers must have a negotiation power. Without this power the lawyer won’t be able to provide you with a good claim. As the opposition group will always have the intention to give you small amount of compensation and resolve the case.

While you consult the lawyer he will ask you about all the important matters related to the victim and the disease. So it’s your duty to provide the lawyer with all the important documents. Missing any of the documents will lead to a great problem in getting the compensation. So to get the right compensation, a good lawyer, important documents and your cooperation is needed.

So your important document will be a key factor for getting a good amount while you claim for Mesothelioma compensation. So make your documents and your statement stronger for getting adequate compensation.

Mesothelioma Claims – What Does Mesothelioma Cause

The link between asbestos and mesothelioma is strong, and mesothelioma claims are increasingly common. Despite this, it’s use can still be seen in many areas of the industrial sector. The lust for profit has resulted in unnecessary exposure for millions of workers, many of whom develop this deadly form of cancer. While many believe that the link between asbestos and mesothelioma was a recent discovery, evidence strongly suggests that this link was identified as early back as the 1930’s. This evidence also suggests that suppliers knew of this link, but did nothing to warn the public.

A Brief History – Asbestos was once an extraordinarily common material in hundreds of products. The best explanation of this is that it is a very effective product. It’s ability to withstand chemical and heat damage lends itself to many practical applications. Products ranging from household insulation, welding gloves and ovens all contained asbestos at one time. The boom in shipbuilding following Pearl Harbor lead to millions of workers being exposed to this product. The carcinogenic effects of cigarettes were further amplified by the use of asbestos fibers in the filters of some brands. Despite the useful properties of asbestos, they are trumped by it’s strong link to mesothelioma.

Symptoms of Mesothelioma – As with other forms of lung cancer, early warning signs are often not present. This is why it is such a devastating form of cancer.

Some forms of mesothelioma can present with early signs, indicating the need for diagnostic testing. Persistent coughing or difficulty breathing indicates trouble in the lungs. This may also include the appearance of blood upon coughing and persistent difficulty with swallowing.

Regardless of asbestos exposure, this should be discussed with your doctor. A change in normal bowel habits or feelings of nausea are often noted, along with weight loss and an unexplained fever. These symptoms tend to accompany periods of unexplainable fatigue.

What to Do – It is very important to seek medical treatment if you suspect past asbestos exposure, or if the symptoms described persist. If mesothelioma is the cause, the prognosis depends heavily on early detection and treatment. Don’t hesitate to seek medical attention, as your life could depend on it.

While a diagnosis of mesothelioma is devastating, there is something that can be done. Seeking legal counsel through a lawyer will help to determine your options. Sometimes, you can find lawyers who specialize in the area of mesothelioma claims.

Asbestos use is an unethical practice, and those suffering from mesothelioma can help stamp out it’s use. By taking legal action, you can discourage it’s continued use and take action against those responsible.

Why You Should Use Mesothelioma Lawyers

Mesothelioma lawyers are for men and women who are sick or who have lost someone because of cancer caused from exposure to asbestos. Asbestos was in the insulation in homes and offices and other things starting sometime before the nineteen twenties. Later it was used to insulate duct work for heat and air and to insulate the insides of nuclear reactors.

By the nineteen twenties it was thought to be the cause of some health problems in some people, primarily in the lungs. During the nineteen thirties and forties, medical proof was offered that showed a link between asbestos exposure and lung disease, specifically asbestos cancer, which has been renamed Mesothelioma. Even with all the evidence showing the hazards of asbestos, most of the companies that manufactured or installed it refused to tell the public of the dangers.

These cover-ups are the reason that there are many suits today involving this illness. When people finally found out about the harmful effects of asbestos and they determined that they were sick, or worse, they were dying because they had been around asbestos they started suing the companies involved in making and using it. Our government is also part of the force making the companies compensate the people harmed by these products.

Mesothelioma lawyers know all the laws and requirements of proof in these kind of civil causes. They can aid people to get through Mesothelioma litigation and file a claim so they can be recompensed for their damages. You have to file suit against the specific company that caused you to be exposed to asbestos. Sometimes, you may also file for compensation if your exposure to this insulation came about because you live with someone who was.

When you win your law suit, you will be eligible to be reimbursed for wages you have lost, medical expenses, for the costs of a funeral, and monetary aid for you or your family. You will most likely be reimbursed for traveling expenses related to your treatments and whatever other costs you incur that may not be covered by insurance also. This money will be of great help to you and the people closest to you during what is most likely going to be the most stressful time of your lives.

Since each case varies, a Mesothelioma lawyer can review additional expenses that could be covered under a claim. For this, they will require your medical records and financial records that pertain to the asbestos induced illness. Once you provide these records and answer all the questions regarding how and when you might have been exposed to asbestos, you should not have to be involved with the rest of the stages of your case. Mesothelioma lawyers know that their clients will probably be too weak and tired to participate in the trial. This is why these lawyers handle every aspect of your case.

Almost all of these lawyers work on a percentage basis. If you win your claim they will take a specified percentage of whatever amount you are awarded to cover their fees. This percentage ranges from twenty percent to forty percent, with the majority charging from twenty-five to thirty-five percent.

So when you are looking for a Mesothelioma lawyer, look for one who’s had some experience with this kind of disease and lawsuit. Make sure they know what this disease is and what causes it. Be sure you understand how much you are going to pay them. Then let them work for you.
